Limitations of Use
The Site is intended solely for use by United States residents who are at least 20 years of age. You agree to use the Site only for lawful purposes and may not use this Site for any unauthorized purpose, including unauthorized entry into our systems or misuse of any information posted on the Site. We may change the Site, or restrict usage for the Site, without prior notice, to be effective immediately. By applying for insurance products through the Site, you are designating us as your agent of record. Bestow‘s Term Life Insurance Policies are underwritten and issued by North American and offered exclusively through the Site. Policies may not be available in all states. Product information and descriptions contained within the Site are not intended to be complete descriptions of all policy terms, exclusions and conditions. Please refer to your actual policy for complete details of coverage. Approval of your application is not guaranteed and is subject to acceptance by North American based upon its underwriting guidelines and your personal health history. Bestow Agency, LLC (d/b/a Bestow Insurance Services in California) is a licensed insurance agency in all states except New York, and license numbers are available upon request (Arkansas #3000081138, California #Ol75933, Louisiana #726591, Texas #2173025). Policies purchased on this site are administered by Bestow Agency, LLC.
We do not provide any legal, regulatory, accounting, or tax advice, and you must rely upon your own advisors before making any financial decision.
Consent to Doing Business Electronically
You may receive disclosures, notices, documents (including your application and insurance policy, if one is issued) and other information (“Communications”) from us. The products and services offered through the Site are available only through the Internet, so we need your consent to conduct business electronically. As used in this section entitled “Consent to Doing Business Electronically”, “us”, “our” or “we” refers not only to Bestow Agency, LLC and each of its affiliates but also North American, the insurance company issuing and underwriting policies.
Scope of Consent
You agree that all Communications from us relating to the products and services offered through the Site may be provided or made available to you electronically by e-mail, by text or at the Site. You further agree that we may accept an electronic signature from you, and that this electronic signature will have the same effect as a physical wet signature and will appear on all records related to any products and services. Your consent also applies to all Communications and information that we receive from you. Your consent is voluntary and, if you consent, you still have the right to receive a paper copy of any Communication by contacting us.
To access and retain Communications, you must have access to a computer or mobile devise with current Internet capability that would allow you to view, print and save Communications, and you must have an email account that would allow you to open hyperlinks to websites.
You may withdraw your consent to receive Communications electronically and to use an electronic signature at any time by contacting us. If you withdraw your consent, you will be unable to apply for products and services through the Site, and we will be unable to continue to process any pending applications for products and services, including insurance products.
Permission to Contact
You give us permission to contact you at any address or phone number provided to us, or known to us, about your Bestow account. Your consent allows us to use text messaging, voice messages and automatic dialing technology, for all purposes. Message and data rates may apply. You may contact us anytime to change these preferences.
Your Obligations and Authorizations
You do not need to register with us to visit the Site. However, to access certain password-protected areas of the Site and to apply for the products and services offered through the Site, you must register for an account. You are solely responsible for the activity that occurs on your account. You must notify us immediately of any breach of security or unauthorized use of your account.
You authorize us to collect and use your information to provide you with products and services offered through the Site and to retrieve and manage your information maintained by third parties, such as North American and other vendors.
You represent that the information you provide to us is accurate and complete. In order to connect the Site with any third-party service, you authorize us to store and use your information, signatures or other materials in order to provide you with the products and services offered through the Site, or to gather and export your information from a third party service to provide the products and services offered through the Site. You understand that you are providing written authorization under the Fair Credit Reporting Act and other applicable law for us to request and receive copies of consumer reports and related information about you from third parties and to release information to authorized third parties.
You agree that you will not: - Misrepresent your identity, or impersonate another person, or hide or attempt to hide your identity; - Produce content that is defamatory, abusive or offensive, disparages or criticizes any person or entity, violates any person’s right of privacy, or is illegal or promotes illegal activity; - Copy, distribute, or disclose any part of the Site in any medium, including without limitation by any automated or non-automated “scraping”; - Use any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., that sends more request messages to our servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser; - Transmit spam, chain letters, or other unsolicited email; - Attempt to interfere with, compromise the system integrity or security, or impose an unreasonable burden on our infrastructure, or interfere with the proper working of the Site; - Upload invalid data, viruses, worms, or destructive features through the Site; - Collect or harvest any personally identifiable information from the Site; - Use the Site for any commercial solicitation purposes; - Use the Site to obtain information about us, the Site, or our customers for the purpose of competing with us or otherwise reproducing some or all of the Site for any reason; - Attempt to decompile or reverse engineer any of the software or underlying technology of the Site or its interactive features; or - Bypass the measures used to prevent or restrict access to the Site.
Any postings to the Site will be considered non-confidential and will be our exclusive property to use for any purpose without compensation. You should assume that everything you see on the Site is proprietary information protected by copyright or trademark unless otherwise noted, and may not be used except as provided in these Terms or with the written permission of the owner of the material. You may not use any names, content, logos or service marks without the express written permission of the owner.
We respect the copyrights of others and will respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act. If you believe that any material contained on the Site may infringe on your copyright, you must provide us written notice, signed by the copyright owner or his/her authorized agent, of the following: (i) identification of the copyrighted work claimed to have been infringed, (ii) identification of the alleged infringing material on the Site and information sufficient to permit us to locate the alleged infringing material, (iii) a statement that the complaining party has a good faith belief that use of the material is not authorized or permissible by law, (iv) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner, agent, or licensee, and (v) contact information for the complaining party so we may send a response. Anyone who knowingly misrepresents that material is infringing in such a notice will be liable for any damages and any associated costs incurred by us.
We may provide hyperlinks to Third Party Sites. Third Party Sites are not maintained by, sponsored by or affiliated with us and are provided solely as a service and convenience to you. Third Party Sites are to be accessed at your own risk, and we make no representations or warranties about the content, completeness, accuracy or security of Third Party Sites.
Disclaimer of Warranties and Limitation of Liability
All information provided on the Site is furnished on an “as is” and “as available” basis, and we disclaim any express or implied warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. We do not represent or warrant that the Site or its content is error free, that defects will be corrected, or that the Site is free of viruses or other harmful code.
Under no circumstances will we be liable to you or anyone else for damages arising from your use of the Site, your inability to use the Site, or circumstances beyond our control, including, but not limited to direct, indirect, incidental, punitive and consequential damages. Bestow will not be liable for any defamatory, offensive or illegal conduct of any user or for any unauthorized use of your account. Your sole remedy for dissatisfaction with the Site is to stop using the Site. If your use of materials from the Site results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof. Some jurisdictions do not allow the exclusion or limitation of liability for consequential, incidental or other damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless the Bestow Parties from and against any and all claims, losses, expenses, demands or liabilities, including attorneys’ fees and costs, incurred by the Bestow Parties in connection with any claim by a third party arising out of materials and content you submit to, post to or transmit through the Site, or your use of the Site in violation of these Terms or in violation of any applicable law. You agree that you will cooperate fully in the defense of any such claims. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you will not settle any claim or matter without our prior written consent.
Governing Law, Jurisdiction and Venue
These Terms and your use of the Site shall be governed by the laws of the State of Texas. Except for proceedings commenced by us, you and we mutually agree that any disputes arising under these Terms will be resolved exclusively by state courts located in Dallas County, Texas or federal courts located in the Northern District of Texas.
We may notify you of any material changes to these Terms by using any of the contact information you have provided to us or by posting a message on the Site’s home page. In addition, we will update the “last modified” date at the bottom of this page.
